Did Apple Photoshop The Galaxy Tab Comparison Pic To Win European Injunction?

Ah, the Steve Jobs reality distortion field rears it’s ugly head again.

 Apple and its lawyers have, perhaps inadvertently, misled the judge of a Düsseldorf court by filing flawed evidence of the similarity between the iPad 2 and Samsung’s Galaxy Tab 10.1 tablets based on an inaccurate picture, an investigation by Webwereld.nl, a Dutch IDG publication, has found.

Photographic evidence submitted by Apple, found on page 28 of the German complaint, shows two pictures: the iPad 2 and the alleged Galaxy Tab 10.1, accompanied by Apple‘s claim that the “overall appearance” of two products is “practically identical.”

It has been pointed out that they may have used an image of a prototype but as the papers were filled on August 4th and the Galaxy Tab 10.1 has been available since May things aren’t looking good for Apple and we may see a reversal of hearing results.

Germany has the same requirements as the US to provide “complete and truthful” evidence in filings such as these, however even if Apple didn’t deliberately try to mislead the Judge (and you know they’ll say they didn’t regardless of the what the truth may be) the damage may already have been done to Samsung.
